Trail vs. Appeals:

When to decide to pursue an appeal, it is highly important to have a clear idea about how the appeal process would vary from what you have undergone during a trail. Arguments would have been made on your behalf during a trail, evidence was presented, and witnesses were called for testimony. During an appeal in the appellate court, the facts about the case cannot be re-argued. But the appellate court will be interested in determining (i) if a constitutional error or procedural error was made in the lower court and (ii) Whether the error impacted the outcome of your case.
But attorney J. Christopher Llinas, will prepare a strong appellate briefing following strict rules of Maryland courts and the reasons why the trail court’s judgments is wrong.

Maryland’s Court Process:

When the court hears an appeal, they will (i) reverse the initial judgment (ii) remand the case for a new trail (iii) affirm the prior judgment and (iv)modify the judgment according to the law which is applicable. Maryland’ Court system has four levels and they are two trail courts and two appellate courts. Lead J. Christopher Llinas, will provide guidance with (i) Appeals from district court to circuit court (ii) Appeals from Special Appeals to Court of Appeals and (iii)Appeals from Administrative Agencies. In an appeal, the courts will review the decisions and the actions made by the trail court.

District and Circuit Courts:

District Court will be available in Maryland’s 23 counties, and these courts handle appeal cases for traffic violation, misdemeanors, certain felony crimes, and landlord-tenant disputes. Circuit Courts handle more typical cases such as criminal cases, major juvenile and family law cases. If you are unhappy with the judgment in the district court, then it can be appealed to the Circuit Court.
