Father Files Federal Complaint Against NYC Family Court Referee for Civil Rights Violations and Unlawful Child Removal
NEW YORK, NY – Tyre F. Newsome, a constitutional advocate and father, has submitted a formal judicial complaint and federal referral to the Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) against Referee Pamela Brett Scheininger of the New York City Family Court and court-appointed attorney Jay Ballard, alleging judicial misconduct, conspiracy to violate civil rights, and systemic violations of due process.

Newsome’s complaint outlines a coordinated scheme that resulted in the unlawful removal of his children without trial, without service of process, and without any findings of abuse, harm, or criminal conduct. He contends these acts constitute federal crimes under 18 U.S.C. §§ 241, 242, as well as civil rights violations under 42 U.S.C. §§ 1983, 1985, and 1986, and may rise to the level of Racketeer Influenced and Corrupt Organizations Act (RICO) violations.

“They kidnapped my children using fake paperwork, with no trial, no hearing, and no notice. This is not just misconduct—it’s organized fraud and a human rights emergency,” said Newsome. “If they can do this to me, they can do it to anyone.”

Key Allegations Include:
Referee Scheininger issued five-year protective orders without jurisdiction, trial, or evidence, violating the 14th Amendment and controlling Supreme Court precedents (Santosky v. Kramer, Goldberg v. Kelly).

Orders were based on alleged defaults with no proof of service, while Newsome was residing in Georgia and unaware of any proceedings.

No emergency or criminal allegations were presented, yet both children were permanently removed from their father.

Scheininger is also President of an Jewish Orthodox Feminist Alliance (JOFA), raising serious concerns of ideological bias in family court rulings, particularly involving fathers. [Source: JOFA Board of Directors – www.jofa.org]

Court-appointed attorney Jay Ballard failed to notify or defend the father, enabling what Newsome calls a “fraudulent and unconstitutional deprivation of rights.”

The complaint asserts that both individuals acted in concert under color of law, forming a conspiracy to deprive Newsome—and likely many others—of constitutional protections and parental rights. These actions, the filing claims, establish a pattern of civil rights abuses that warrant federal prosecution and RICO indictments in Newsome's opinion.

Criminal prosecution of Scheininger and Ballard under civil rights statutes.

Disbarment and removal from office for both parties.
