:Bren Champions Real Estate project on Sarjapur Road has been facing vandalism, threats and extortion from locals manipulated by the original owners. The registration of the property was done as early as 2010. The owner of the property Mr. Krishnappa had allocated 12 ft access road along the road-facing properties of his brothers.

In 2012-13 as per Phodi the survey numbers changed.
Mr. Krishnappa sold it again illegally to a third party, belonging to the scheduled caste and by that claims the property to be belonging to SC. In this pretext they have been demanding money in extortion mode. Krishnappa has entered into agreement with MR Muniraju with malafide interest to extort the money from Champions, the legitimate owners of the property.
The honourable High Court of Karnataka has issued an Injection order against Mr. Muniraju and still police not taking any action against the same person despite of complaint several times. Mr. Krishnappa, Mr. Muniraju and their complicits have been vandalizing the property, pelting stones, and destroying machinery including JCB excavators.
Muniraju and Krishnappa, along with some locals, are threatening every day at the site throwing stones at workers and employees with some getting severely hurt. The attack has already damaged several assets of the property. Despite complaints being filed, the police are not taking any action. On the other hand they are allowing these goons to make more damage at the site.
The accomplices of this criminal initiative are falsely defaming the genuine owner and developer through false accusations in malafide pamphlets defaming the owner and hampering the smooth execution of its work and delivering the project on time to the clients who have paid their hard earned money.
As per the order passed by the Honourable High Court, the developer has commenced to complete the development work. But despite the Interim Order passed by the Honourable High Court, Mr. Krishnappa and the persons claiming under him in particularly the agreement holder Mr. Muniraju has threatened to stop the developmental work.
Champions Group claimed and substantiated along with the necessary documents that it is the absolute owner of the converted land/property measuring 1 Acre 20 Guntas in Sy. No. 46 (New Sy.No. 46/1) before the Phodi of the said extent out of total extent measuring 4 acres 14 guntas, situated at Mulluru Village, Varthur Hobli, Bangalore East Taluk. The Company purchased the aforesaid property from Mr. Krishnappa, S/o Late Kempaiaha, (residing at No.38, Near Mullur Government School, Mullur Village, Varthur , Bangalore East Taluk) under the Registered Sale Deed dated 30.10.2010.
The Company also perused document reflecting the Conversion Order dated 09/09/2010 wherein the sketch adduced by krishnappa reflects that he has shown the 7 and ½ Guntas (presently numbered as 46/3)out of the said 4 acres 14 Guntas as road to reach his land measuring 1 acre 20 guntas. That the aforesaid Krishnappa and his brothers, who were the owners of the adjacent properties were using the said land measuring 7 ½ Guntas as common access to reach the land in Sy.No.46 from the main road and same was Ordered in High Court Order in RSA No. 232/2003 (filed by Krishnapp against his brothers) dismissing all false claims of Krishnappa and by confirming the said land as access-way to reach Krishnappa’s land which carved out of the lands of his brothers.
Mr. Krishnappa absolutely transferred the land measuring 1 Acre 20 Guntas in Sy.No.46 (New Sy. No.46/1) along with his right to use the land to the extent of 7 and ½ Guntas in Sy.No.46 (New Sy.No.46/3) as access way to reach his land in Sy. No.46 from the main road which is reflected in clause 3 of the registered sale deed. Thus, Mr. Krishnappa has no subsisting right either in the land measuring 1 acre 20 guntas or in 7 ½ Guntas. Subsequently the land was Phodied and re-numbered in the year 2011-12 and the said land measuring 1 acre 20 guntas numbered as Sy.No. 46/1 and 7 and ½ Guntas land numbered as Sy.No. 46/3 as reflected in MR No.24. Later, the Company upon realising that the said 7 ½ Guntas land was converted and as Company realised that Krishnappa’s brothers had common interest in the said land and hence with view to have absolute right over the said 7 and ½ Guntas, Company executed the Release Deed with Mr. Krishnappa’s brothers namely, Mr. Narayanappa and Mr. Venkataramanappa and thereby the said brothers also relinquished their respective rights in the land measuring 7 ½ guntas vide Registered Release Deed dated 10.10.2014.
That with an intention to develop the land in Sy. No. 46/1, 46/3 along with the other land owned and possessed by the Company, entered into a Joint-Development Agreement with Bren Corporation Private Limited (the Developer) and the Developer has developed the land in Sy. No.46/1 and also utilising the rights over the land consisting in Sy. No. 46/3.
Post obtaining of the necessary permissions and approvals including RERA REGISTRATION from concerned Government Bodies, the Developer has put up substantial construction in the said Property by investing huge amounts. The developer and the owner have entered into several agreements with general public who are the purchasers of the apartments. Krishnappa and other persons claiming under him, his agents, servants and men who has no right whatsoever upon the said property tried to trespass into the said property and making frequent visits to the said property with a dishonest and malafide intention to disrupt the developmental activities and threatening the company of dire consequences with sole intention to extract money from the Company and harass the Company.
Even though the company has given multiple complaints to the police about this malafide interventions and trespasses, the police has not taken ample measures to protect the rights of the legitimate owner Champions group or the developer Bren Corporation.
We request the honourable executive and judicial machinery of the government as well as the fourth estate to take necessary measures to ensure justice to the legitimate owners who have invested large sums of money for the genuine real estate projects pursued through legitimate modes of transactions honouring the laws of the land.
We request the law enforcing machinery of the government and the media—the fourth estate who are the watch guards of democracy—to ensure that we are safeguarded against the extortions and serious threat to life of the employees at site. We are worried about the police not giving us adequate support and care despite the incidents taking place every day. A certain faction of the police are seen sheltering the perpetrators of evil.
