Assignment of the unregistered mark:
Article 39 states that an unregistered trademark can be assigned or transferred with or without the goodwill of the facility concerned. The invitation must be in the form TM-16 to allocate or transfer the unregistered trademark.

Article 38 states that trademarks are often either entirely or partially sent out, with or without goodwill to the company. All transmissions or assignments should be registered with the Registrar of Trademarks on type 23 or 24 brands according to the sixty-eighth rule of the Logos Rule for 2002.
