Procedure to Obtain Hong Kong PR Status

Hong Kong is a favorite destination for global businesses and is a hub for a large number of multinational companies. An individual can acquire Hong Kong PR (Permanent residence) irrespective of their nationality.

An individual can acquire Hong Kong PR (Permanent residence) irrespective of their nationality. For Chinese nationals, it is a much easier process. All foreign nationals, including Indians, have to go through a different process and must comply with certain requirements.

Let us discuss a few notes on obtaining Hong Kong PR for Indian nationals (same as foreign nationals):

Hong Kong Immigration authorities have classified foreign nationals into several categories, based on which, a permanent resident status will be issued.

1. One of the basic requirements for an Indian national is that he/she must have resided before or after the establishment of HKSAR (Hong Kong Special Administrative Region) for a continuous period of more than seven years.
2. Applicant is required to submit a declaration to the director of immigration stating that he/she has taken Hong Kong as their permanent residence.
3. If the applicant is less than 21 years of age, his/her legal guardian or parent must submit the declaration.
4. Applicant must have a valid passport.

Transitional Arrangements:

Individuals can also obtain a Hong Kong PR even though they cannot comply with the aforementioned requirements. Hong Kong immigration department has made some exemptions to individuals under some special cases.

1. Applicant can avail HKSAR PR if he/she has settled in Hong Kong before 1st of July 1997.
2. Applicant who ceased to settle in Hong Kong before 1st July 1997 and returned within a period of 18 months can obtain a permanent resident status.

It is important to note that a person can lose his/her permanent resident status if they fail to comply with the aforementioned norms. However, a candidate may be allowed to enter the Hong Kong Special Administrative Region to live freely, work and pursue their education. After meeting set guidelines, he/she will obtain eligibility to avail Hong Kong PR status.

What it means to be a Hong Kong Permanent resident:

A person with permanent resident status in the region will have the right of abode in HKSAR. This means, they shall have the right to land in Hong Kong and there will be no restriction on their stay. A person with right of abode shall not be deported or removed from Hong Kong Special Administrative region.
