An attorney and spokeswoman from the Herman Legal Group was asked to give comments in respect of the categories in the employment based green card visas. She gave comments on EB1 in respect of Priority Workers and EB2 in respect of Professionals with Advanced Degrees Exceptional Abilities in Part 1 of this press release. She continued to give comments on the three other employment based green cards available for persons who wish to work and live in the U. S.

3.EB3 – Skilled Professionals and other workers – the spokeswoman stated that, for this category labor certification was a requirement for all petitions with the exception of applicants who qualify for Schedule A Shortage Occupation. She explained that shortage occupations are; “occupations or jobs whereby there are not sufficient U. S. workers who are able, willing, qualified and/or available to fulfill specific jobs that are outlined in Schedule A. Some jobs or occupations in the Schedule A list included: nurses, physical therapists, scientists etc.” she further stated that the skilled professionals and other workers employment based green card has three subcategories for:

Skilled workers – this covers positions that require at least two years of experience

Professionals – the minimum qualification for a professional would be a baccalaureate degree or a foreign equivalent. Further, the degree requirement must be a normal requirement for the position.

Other workers – this covers workers that do not qualify for the other categories. It can also be called the unskilled workers category. In respect of this category only ten thousand visas are reserved for this category and this category has a long backlog

4.EB4 – Special immigrants – this category caters for a different type of occupation. The spokeswoman stated that; “this green card was only open to a few persons mainly because only seven point one percent (7.1%) of all employment based visas were allocated to this category as a result. The special immigrants employment based green card caters for religious workers, employees and former employees of the U. S. government abroad and persons who serve as translators with the U. S. Armed Forces.” As a result only such persons qualify for this category of employment based green card.

5.EB5 – Investors – while to others it may not seem to fall under employment for foreign nationals it in essence does as the investor will be working in the U. S. There are ten thousand visas available each year for investors under the investors employment based green card. This is specifically for individuals investing in a new commercial enterprises. The basic requirements that would make an applicant eligible are:

The minimum investment of five hundred thousand dollars, if the investment is in a targeted employment area. However, if the investment is not in a targeted employment area the investment minimum is one million dollars.

The enterprise must create full time employment for at least ten people. The ten people that are employed full time excludes any family members.
