There are a number of questions that are commonly asked with respect to traffic accidents.  For example, with regard to fault, proof, and insurance after a traffic accident. This article will discuss frequently asked questions relating to traffic accidents and answers will be provided by an attorney from Crowson Law Group.

What determines who is at fault in a truck, motorcycle or car accident? With respect to traffic accidents, fault is determined by deciding who was careless. With respect to vehicle accidents, there is a set of official written rules that guide people on how they are supposed to drive and that provide guidelines by which liability may be measured. Such a set of rules is the State Vehicle Code, which applies to automobiles as well as motorcycles, bicycles and pedestrians. At times, a violation of one of these traffic rules is obvious and may be the cause of an accident. However, in other situations a violation may not be obvious – in these instances, one must often apply the law of negligence. Negligence is whereby an individual behaves in a thoughtless and careless manner and is found to be at least partially at fault for causing an accident. In order to prove negligence four elements must be met:

the driver is legally required to be reasonably careful in the particular situation

the driver was not reasonably careful

the driver’s conduct caused actual injury or damage to someone

the injured person suffered some damage or loss

Is a car making a left turn always at fault in an accident? The attorney stated that, “in almost all cases a car making a left turn is liable to a car coming straight in their direction. Is a car making a left turn always at fault in an accident? The attorney stated that, “in almost all cases a car making a left turn is liable to a car coming straight in their direction. However, there are exceptions to this almost automatic liability, these are:

the car going straight was going too fast, however, this exception is usually difficult to prove

the car going straight went through a red light

the left turning car began its turn when it was safe but something unexpected happened which made it have to slow down or stop its turn”

It is important to note that the law says the car making the left turn must wait until it can safely complete the turn before moving in front of oncoming traffic. Further, the location of the damage on the cars sometimes makes it difficult for the other driver to argue that the accident happened in some way other than during a left turn. Therefore, despite the three exceptions it is almost always determined that the car making the left turn is liable for the accident.

As a victim of a trucking accident, who can I sue? To this the attorney stated that, “victims of a trucking accident need to understand who is responsible for their injuries and this can be complicated. Often there are a number of players that may be liable for the accident and figuring this out is not always easy.” Some of the people and companies that may be legally liable for the truck in accident include:

the truck driver

the owner of the truck or trailer

the person or company that leased the truck or trailer from the owner

the manufacture of the truck, tires or other equipment that may have caused the accident

the shipper of freight loader.
