SGS Summarizes Listing of BPS as a Prop 65 Substance in California

SGS publishes SafeGuardS looking at California’s addition of BPS as a Prop 65 listed chemical.

 
SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 001.24 detailing California’s addition of bisphenol S (BPS) to the list of Proposition 65 (Prop 65) chemicals. The California Office of Environmental Health Hazard Assessment (OEHHA) added this analogue of bisphenol A (BPA) to the Prop 56 list on December 29, 2023.

BPS is used in a variety of consumer products, including thermal paper, hard plastic items and synthetic fibers for clothing and textiles. It is added to the Prop 65 list as a chemical that is known to be a female reproductive toxicant.

Under the terms of Prop 65, businesses operating in California are required to provide a clear and reasonable warning before knowingly and intentionally exposing anyone to a listed chemical. Currently, there are approximately 900 chemicals listed. Unless exempt, businesses have 12 months to comply with the provision once a chemical is listed, meaning all companies must observe the requirement for BPS by December 29, 2024.

Prop 65, the ‘Safe Drinking Water and Toxic Enforcement Act of 1986’, is a unique piece of legislation that was passed overwhelmingly by Californian residents in November 1986. It requires the state to publish a list of chemicals that are known to cause cancer, birth defects or reproductive harm.
