New Pacifier Ordinance in Brazil

A look at Brazil’s latest ordinance for pacifiers, which came into force on August 2, 2021.

 
Stakeholders are reminded that Brazil’s new ordinance for pacifiers came into force on August 2, 2021.

Issued by the Brazilian Ministry of Economy/National Institute of Metrology, Quality and Technology (INMETRO) on July 16, 2021, Ordinance No. 301 of July 12, 2021, details the consolidated conformity assessment requirements and conformity identification seal for pacifiers.

Provisions included in the ordinance include:

• Establishing:
o Annex I – consolidated legislation for pacifiers in the form of conformity assessment requirements
o Annex II – specifications for the Conformity Identification Seal
• Conformity assessments must be carried out by a Product Certification Body (Organismo de Certificação de Produto, OCP), established in Brazil and accredited by INMETRO
• Suppliers must choose Certification Model 1b (batch test) or 5 for conformity assessment requirements – the Certificate of Conformity (CoC) for Model 5 is valid for four years
• Certified products that have been issued must be evaluated against the new ordinance at the next evaluation – the requirements related to the validity of the certificate and the timing of maintenance assessments (Annex I to the Ordinance) will apply to certificates already issued by consideration of their issue date

Stakeholders should be aware that this Ordinance entered into force on August 2, 2021. Pacifier suppliers have until December 31, 2021, to adapt the layout of the Conformity Identification Seal (Annex II).
