Brazil Updates Ordinance for Toys

A look at Brazil’s latest ordinance for toys, which came into force on August 2, 2021.

 
Stakeholders are reminded that Brazil’s new ordinance, detailing the consolidated technical regulations and conformity assessment requirements for toys, came into force on August 2, 2021.

Published by the Ministry of Economy/National Institute of Metrology, Quality and Technology (INMETRO) as Ordinance No. 302 of July 12, 2021, it contains several important provisions, including:

• Establishing consolidated regulations for toys in the form of:
o Annex I – quality technical regulations
o Annex II – conformity assessment requirements
o Annex III – specifications for the conformity identification seal – suppliers may choose Certification Model 1b, 2 or 5 for conformity assessment requirements
• Certified toys to be registered with INMETRO
• In-scope toys are subject to market surveillance
• Suppliers must furnish the required information within 15 days when requested by INMETRO
• Provides a (non-exhaustive) list of products that are considered as:
o Annex IV – considered toys
o Annex V – not considered toys

Stakeholders should be aware of the following important dates:
• January 1, 2022 – domestic manufacturers/importers to only produce/import compliant toys
• January 1, 2023 – domestic manufacturers/importers to only market compliant toys
• July 1, 2025 – establishments to only distribute or carry out commercial activity with compliant toys

Ordinance No. 302 states that certificates based upon previous ordinances – Nos. 563/2016 and 217/2020 – should be assessed against the new law at the next evaluation.
