There is a way to get coverage for a used car under federal lemon law

The different lemon laws prevalent in different states here in the US provide ample assistance to new vehicle buyers to get a redressal against manufacturing defects. However, when it comes to used cars, the lemon law will be less likely to cover the same.

A Used Vehicle Lemon Law will emerge in favour of the consumer in one major case – if the consumer has received an express written warranty, then there is a high chance that that the federal lemon laws will cover the used car. The written warranties can take shape in three major formats –

1 – It carries forward the balance of a manufacturer’s warranty,
2 – It includes a separate limited warranty provided by the dealer, or
3 – It is an extended warranty bought by the consumer at the time of the vehicle purchase.

In case a second-hand car has any of these formats of warranties applicable, then a used vehicle lemon law will be applied.

Some states too could be of help

Some states see a huge occurrence of lemon vehicles and recalls. In such a case, it may pass a legislation that protects the interest of the lemon car buyer. Under this, the state may make it mandatory for every used car to come with a statutory warranty. Now, if the consumer finds it to be a lemon car that cannot be rectified even after three to four attempts, then the person can file a case under the lemon law against the dealer. The dealer has to necessarily replace the car or refund the buying price to the consumer.

The consumer gets additional protection in the form of consumer protection statutes in some states. These laws are made to avoid deception during the sale and mandates the seller to answer all of the buyer’s questions in total honesty. In case the buyer buys a car against false representation, then he/ she is empowered to file a case in the state consumer protection court.

The fact still remains that very few states’ used vehicle lemon law regulations would be in favor of the consumer. Hence, it makes sense to do the homework and hire a lemon lawyer to fight the case on your behalf.
