On April 6, 2022, the No-Fault Divorce Act went into effect. As a result, there is just one ground for divorce in England and Wales when a marriage has irreversibly broken down. The divorce applicant must provide a statement of the irreversible breakdown of the wedding.

The divorce Respondent no longer has the option of contesting the divorce decision. Instead, both parties can file a divorce petition together, and they will be referred to as Applicant 1 and Applicant 2.

Inevitably, parents will engage their children in the breakup of their relationship. There are several Court Orders available to protect them, but they are only enforced by the Courts if there is a necessity (known as the No-Order principle) and if it is in the best interests of the kid.

This program aims to help separated parents address concerns outside of the court system or, if that is not possible, expedite the court process. Before applying to the court, the prospective Applicant must first meet with a Mediator for a Mediation Information and Assessment Meeting (MIAMS).

This is an appointment with an independent Mediator to discuss whether the issues can be handled without going to court. Some instances will be exempt from MIAMS. However, this is something that your Solicitor can explore with you.
