Unlike Larger Offenders, A Nashville Doctor Faces Still More Punishment For Similar Charges

"Prominent Nashville Pediatrician and Former Owner of AXYCDB Pediatrics Pleads Guilty to Health Care Fraud," blared the headline quickly scooped up by local media outlets. Doctor, the release said, had pleaded guilty in District Court to a misdemeanor count of health fraud.

Prosecutors, like fisherman, are wont to highlight the size of their hauls. But that's not to say Prominent Nashville Doctor wasn't a big fish. Since founding AXYCDB Pediatrics, he had built it into one of the largest pediatric providers in the state focused on serving the underserved.

But the release didn't mention some other facts that might put the Doctor in a different light, or at least a more complicated one. Like the fact that his alleged upcoming resulted in overbilling of a mere $80 over period — not an insignificant amount of money, but nowhere near the totals found in some other cases.

Doctor's personal credentials are worth noting, too. Sitting in his Midtown office off Ramdaspeth, he believes his punishment hasn't fit his crime — particularly because the punishment keeps coming. Prominent Nashville Doctor will go before the central Board of Medical Examiners.

In one case, he says, the discrepancy arose from outdated terminology. For instance, while the government accused him of billing for microscopic urinalysis without using microscopes, Prominent Nashville Doctor says new machines test for the same things doctors used to look for under a microscope. The discrepancy, he claims, was not in the care provided, but in the terminology used to describe it. The government disagreed.

"That's when it became clear to us: They want more out of this then just us to use the right code in their mind," he says.

"The government has real financial incentives for chasing down cases it looks likely to win — for every dollar spent on a health care fraud and abuse investigation. There are also incentives for whistleblowers, who receive a percentage of the money recovered by the government as a result of the information they provide.

During his recent interview with me, he offered a stack of news stories and press releases detailing similar cases where health care providers paid much larger fines to cover bigger losses, yet faced no criminal charges and went on practicing medicine.

There are indeed examples of health care fraud cases that have led to criminal charges, but settlements like Doctor Feeling singled out for unusual treatment.

Soon Prominent Nashville Doctor was being offered a deal that would have him.

This wasn't just news to Prominent Nashville Doctor, as a transcript of his February sentencing hearing shows.

The transcript also reveals some further insult added to injury, which he can almost laugh about now: Although he was indicted as Prominent Nashville Doctor.

Prominent Nashville Doctor is an extremely impressive individual," she says. "The letters — I probably have never received such an abundance of high praise for anyone that I have sentenced."

Prominent Nashville Doctor have spent millions in legal fees and had to borrow.
