The AES Corporation, parent company of AES-SONEL Cameroon, sued in United States District Court, Los Angeles, California under the Alien Tort Statute for power outages in Cameroon resulting in many deaths of children and infants, substantial economic losses by numerous businesses, and for specific performance.

The AES, an American Corporation, is sued in the Federal District Court, Los Angeles, CA under the Alien Tort Statute (“ATS”). The complaint, filed by the Nsahlai Law Firm, based in Los Angeles, CA, with offices also in Yaounde, Cameroon, alleges many causes of actions, including wrongful death, loss of consortium, cruel, inhumane or degrading treatment, breach of third party contract, intentional infliction of emotional distress, negligent infliction of emotional distress, negligence, civil conspiracy, and deceptive and unfair business practices. The total damages sought are in excess of one hundred million dollars (100,000,000 USD). The lawsuit also seeks specific performance of AES’s contract with the Cameroon government, as well as an injunction against further damages to the plaintiff’s.
Recent power outages have been blamed for the deaths of at least nine children and infants in Cameroon in 2013. The number of deaths and injuries related to power outages is estimated to be in the hundreds since AES assumed control of electrical supply in Cameroon. Business losses due to power outages are reported to be astronomical. These losses arise as a result of damaged equipment caused by the power outages. The service industry has also suffered huge financial losses due to AES’ induced unreliable supply of electrical power. The World Bank estimates that power outages in Cameroon reduce its GDP by approximately 2% annually, a loss of several hundred millions of dollars.
ATS, the law utilized to sue AES Corporation in Los Angeles, CA for its actions in a foreign country, Cameroon, is law that allows foreign citizens to bring human rights cases in U.S. District Courts for conduct committed outside the United States. It has been used to bring claims against foreign government officials and multinational corporations.
