How To Do a Trademark Search in India- A trademark is a mark, expression, or design that identifies goods and services from a specific source. A registered trademark provides its owner with the exclusive use of a mark to represent or identify their goods and services. Intellectual property vigilance has steadily improved among Indian companies over the past few years, and the number of trademark applications has gradually increased.

Therefore it is important for existing and new companies to register their marks and to be aware of trademark filings that are similar to the company’s interests. In this article, we will discuss the process of how to search for brands in India.
Search for brands
Trademark searches can be performed in the government’s Indian Trademark Registry database or on third-party service provider websites. Trademark Research determines whether a prospective trademark is present for use in relation to certain goods and services. In trademark searches, it is widely possible to search in India, word-like wordmarks as well as phoneme-like names in a specific category.

Online trademark searches in the Trademark Registry of India can be performed freely at the Indian Trademark Database link.

Three categories of brands search
• Wordmark – to represent both wordmarks
• Vienna Law – for Technical Representation
• Phoneme – for phoneme words alike.
Since there are three search type options, which include wordmark, Vienna Code, and audio, one needs to specify the search type from the options specified in the tab.

Wordmark Search
For example, to perform a wordmark tag search, select the “wordmark tag” option from the search type, and enter the proposed trademark keywords in the equivalent box for “wordmark tag.”

There are 45 categories of trademark registration. Categories 1 through 34 deal with different commodities and categories 35 to 45 deal with services according to the Nice Classification. Accordingly, one must enter the category in the correction box to “CLASS”. Categories should be related to the brand’s goods and services. In India Trademark Database, one can only search with one category at a time.

One can perform a wordmark search using any type of prefix method, such as begins with, contains, or matches with.

Search using the keyword will appear in the ‘Start with’ option for all brands starting with the keyword searched for in results. Likewise, search using the keyword will appear in the ‘contains’ option for all brands that contain the keyword searched for in results. On the other hand, with the “match with” option, all brands that match only the keyword searched for will be shown in the results.

After entering all of these required details as above, click on the “Start Search” button to display the search result. Relevant details of each of brands such as S. No., Matching brands, and pictures on the table. One can click on the checkbox shown in S. No. The trademark required to click or display the box in the upper-right corner to view all search results. After checking the boxes, click ‘Report’ to view all brand results in detail.
After doing the trademark search and if it is found that there are no trademarks alike in the registry, one can proceed to submit the trademark.

Voice search
Voice search is the same as the tag search method above words, except without any prefix method. Therefore, one can follow the same step mentioned above for the brand’s voice search.

Search Vienna icon
The search for the Vienna code is mainly performed to find the matching device tag, and one will have to enter the six-digit Vienna code in the matching “Vienna code”, then select the relevant category. After searching, the results table will display all tags that contain the device.
