In a bid to address the growing housing needs of residents and follow through on the province’s ambitious goal of building 1.5 million homes, the Ontario government has passed new housing legislation. This legislation overrides certain municipal zoning laws and eliminates some development fees, enabling more flexibility in the construction of additional housing units.
In 2022, the Town of Milton enacted significant changes to its by-laws concerning second-dwelling units. These new laws are designed to adapt to the evolving needs of residents and facilitate the creation of additional living spaces. Key changes include:
Eligible Structures: A second dwelling unit can now be built in detached, semi-detached, and townhouses. For townhouses, construction of a second dwelling unit is allowed only if there is the possibility of having a side or rear entrance.
Parking Requirements: Each dwelling unit must have one dedicated parking space. For example, if a house currently has one parking space, an additional space is required to build a second dwelling unit, making a total of two parking spaces necessary.
Parking Location: Parking must not be on the street; it must be either in a garage or driveway.
Garage Parking Dimensions: 2.9 m x 6 m
Driveway Parking Dimensions: 2.75 m x 5.5 m
These new regulations open up opportunities for property owners who previously did not qualify for second-dwelling units. This is an excellent chance to start earning rental income by utilizing the new laws to build additional units on their properties.
