When Can a Buyer Foreclose Redemption Rights?

Whoever holds a tax lien certificate can file a complaint to foreclose any redemption rights at the following times:

• Six months after the date of sale
• Two months after sending the first notice
• 30 days after sending the second notice (must send after a week of sending the first notice)

What Happens Once a Tax Lien Certificate Holder Files a Complaint?

Once someone files a complaint to foreclose redemption rights, the court will summon the defendants and order a publication for the foreclosure proceeding. The summonses and the publication order will state a date at least 60 days after the foreclosure order. Within this period, anyone interested in the property can challenge the complaint or redeem the property.

When Does the Final Judgment on the Property Happen?

Final judgment on the property up for a tax sale comes after the specified time in the issued summons, results of litigation, if any, and the result of the motion for judgment filed by the certificate holder. . Tax lien certificate purchasers can then apply to possess the property.
