St. Louis-Based Law Firms File Suit against Online Fantasy Sports Website Draftkings

DraftKings is one of several companies that have recently started operating in the “daily fantasy sports” industry.

ST. LOUIS, Mo (May 27, 2015) – Anthony Bruning of Lertiz, Plunkert & Bruning and Richard Cornfeld, of the Law Office of Richard S. Cornfeld, have filed a lawsuit against online fantasy sports company DraftKings in the United States District Court for the Southern District of Illinois alleging that the company engaged in deceptive advertising practices.

DraftKings is one of several companies that have recently started operating in the “daily fantasy sports” industry. Unlike traditional fantasy sports, which require participation for an entire season, these companies offer fantasy sports competitions that last a single day or, in some cases, a weekend. Because most states view fantasy sports as a game of skill rather than a game of chance, these sites are generally not affected by state laws that prohibit gambling.

According to a report published by the Washington Examiner, the lawsuit centers around DraftKings alleged failure to pay an advertised 100 percent first-time deposit bonus. The plaintiffs, Cory Hemrich, who deposited $25 through the website, and Cooper Ogburn, who gave the company $250, never received the bonuses they were promised. According to the complaint:

“Specifically, to receive their so-called “bonus,” consumers have to pay to enter contests and then receive only a small amount, four percent or less of every dollar they spend within four months, until those small returns total the initial deposit or the four months expire.”

A separate report published by Legalsportsreport.com indicates that there are at least two other cases against DraftKings that are pending. The lawsuit requests class action status for similarly situated individuals in Missouri and Illinois, and reports indicate that the plaintiffs expect damages to exceed $5 million, exclusive of court costs.
