In the with the Western Australian Worker's Compensation system, if an injured worker wants to pursue a common law claim in negligence against their employer, then they must be reviewed by an approved medical specialist before the termination date. The termination date is usually 12 months after the date that the injured worker made the work is compensation claim.

To be an approved medical specialist, the specialist must be approved by WorkCover Western Australia, the workers’ compensation regulatory authority in Western Australia. For a long period of time it has been the case that most, if not all, of the of the approved medical specialists approved by WorkCover Western Australia were within Western Australia. If workers were injured within Western Australia, but then move to the states, they were left with the bleak choice of either being reviewed by insurance specialist who travelled to the eastern states or to take a long and expensive plane journey to Western Australia where they would be faced with accommodation expenses as well as the expenses of the approved medical practitioner. This is now no longer the case, and several medical practitioners in New South Wales and Victoria are now approved medical specialists allowing additional choice and convenience for injured workers.

Pursuant to the provisions of the workers’ compensation and injury management act 1981, the employer/insurer is liable to pay the costs associated with the review of an injured worker, for common-law purposes, so long as that review is before the termination date. This means that injured workers can provide the invoice for the service to their Worker's Compensation Insurer, who will normally pay it in the same manner as they do medical expenses. In the event that a Worker's Compensation insurere refuses to pay the cost of the review at associated report the injured worker can apply to WorkCover for determination that the insurer must pay the cost of the report.
