In a divorce process, there are a lot of matters that need to be settled, one of which is child support. Child support is the amount paid by one spouse to the other to pay for the child’s needs. Florida courts have child support guidelines to estimate the amount of child support that needs to be paid. However, there comes a time when the established amount may have to be modified because of changes that occur.

In Florida, child support modification can be requested with a substantial change in circumstances. This can include:

· Income changes. Significant changes in either parent’s income can warrant a modification. These may come in the form of a job loss or losing a main source of income, which can affect the financial ability of both spouses, leaving either the supporting spouse unable to comply with the full payment or the receiving spouse needing additional support. An increase in income can also justify the need for a change.

· Changes in the child’s needs. Time and circumstances change a child’s needs, and thereby necessitate the need for a modification. Daycare expenses initially incorporated in the agreement may have to be modified in cases of changes. Other additional costs may stem from the child’s changing needs with growth, such as health insurance, and medical and educational expenses, which can justify the need for child support increase.

Under Florida statute, child support modification is allowed, with the provision that the amount change would have a 15% difference from the previous amount established, or a change minimum of 50 dollars per month, whichever is greater.
