Child Endangerment Elements and Penalties

This article discusses the elements relating to child endangerment and the associated penalties of such crimes.

 
The Press of Atlantic City published an article entitled, “How Domestic Violence Intervention Programs Helps Batteries and Victims”, on June 11, 2017. The article discussed the Atlantic County Women’s Shelter Fathers Ending Abuse battery intervention program. The article further went on to say that it undertook the counselling of domestic violence criminals as requested by the relevant Court sentence for receiving counseling. It spoke of a man who physically assaulted his girlfriend and how the program had assisted him. The man documented in the article referred to as M was a father of four and has a career as a music engineer. The program is designed to provide counseling for both victims and batterers in the hope to eradicate domestic violence. The man was said to have physical assaulted his girlfriend and this could have easily resulted in child endangerment charges had the abuse taken place with a child or in front of his children. In respect of such child endangerment laws an attorney and spokesperson from the Law Offices of Randy Collins discussed child endangerment.

Penal code 273a defines child endangerment as ‘domestic violence against a child where a person commits an act of battery against a child or allows harm to come to a child by way of an intentional act or as a result of negligent failure to act’. The attorney stated that in order to be convicted successfully of child endangerment there is need to have evidence that the individual:

caused or allowed a child to be harmed whether physically or mentally, either intentionally inflicting, allowing or causing the physical pain or mental suffering of a child
caused or allowed a child’s injury or endangerment while the child was in the individual’s custody
acted in a certain way that was likely to produce great harm or death
acted in a negligent way at the time of the offence
was not reasonably disciplining the child
The attorney further stated that where an individual is facing charges for violating California Penal Code 273 or 273 PC, the perpetrator may attract the following penalties associated with child endangerment:
In the case of child abuse misdemeanor, imprisonment in county jail for a period of up to 1 year. In the case of a felony child abuse charges the individual can be sentenced to imprisonment for up to 6 years
a minimum probation period of 48 month
participation in and completion of at least one year of child abuser’s treatment counseling program and payment of fees due for the counseling program
Abstinence from the use of drugs or alcohol during the probation period and subjection to random drug tests, in the event that the offence happened while the accused was under the influence of such a substance.
When a violation results in serious consequences, the penalties differ for example whereby:
The child was under the age of 8 at the time of the incident and the offence resulted in the child’s death, the accused faces imprisonment in state prison for 25 years to life
The child was under the age of 8 and the offence resulted in the child becoming comatose or permanently paralyzed; the accused would face imprisonment in the state prison for life with the possibility of parole.
