Today, many people have ideas for novel products and services. Some people will pursue their ideas and others will not. Society will benefit from some great ideas and society will also lose out on potentially revolutionary products because some people did not pursue their ideas. As the saying goes, “some of the best ideas are in the graveyard.”

Patent attorney Darcell Walker says that “lack of knowledge and lack of resources are major obstacles that prevent people from pursuing their ideas. Many people do not know the process for developing ideas. An even larger obstacle is that persons do not have the financial resources needed to retain qualified professionals to assist them.

Walker has concluded that some people should consider going alone and doing it themselves. Although Walker does not advocate persons trying to navigate through the product development process alone, the reality is that some people just cannot afford to pay for help. He says, “if some people do not do it themselves, it will not get done.” This fact is particularly true with regards to protecting ideas. Attorney Walker counsels people desiring to protect their ideas. However, many individuals cannot even afford discounted fees.

Some individuals, who do not have the resources to hire Attorney Walker, do inquire about the possibility of him coaching them through the process. As a result, he is developing a set of presentations in CD format that will provide information and instructions to persons desiring to ‘do it themselves.’ The presentations cover business and legal concepts which include the phases of product development and strategies for presenting an idea to a company. The presentations explain patents, copyrights and trademarks and the processes for filing each type of application. The presentations also discuss how to protect ideas with prudent business practices even before one is ready to file for formal patent, copyright or trademark protection.

The ‘do it yourself’ concept is common in our society. However, many currently available publications and services related to protecting ideas only focus on the mechanics of filing a formal document. Walker’s materials provide strategies for protecting an idea throughout the development process. Walker wants people to be able to start the process of pursuing their ideas and then seek funding that will enable them to continue the pursuit. For example, it helps when a person can approach a company or funding entity with a ‘patent pending’ product instead of just an idea concept. Too many ideas are lost because of the lack of resources to start the process. Attorney Walker wants to help change that trend.

Darcell Walker has over 22 years of experience practicing intellectual property law (i.e., patents, copyrights, trademarks, trade secrets, and product licensing). Since 2002, Attorney Walker has also conducted intellectual property workshops for the University of Houston Small Business Development Center.
