Pedestrian Accident Dos and Don’ts

Posted April 14, 2017 by crowsonlaw

This press release discusses what should be done in the case of a pedestrian accident and what information should be provided by the driver.

Two cars were involved in an accident that resulted in four pedestrians being hospitalized. The accident occurred on or about November 30, 2016. At the time of the report it was unclear who was at fault for the accident. According to statistics reported by the National Highway Traffic Safety Administration in 2006, over sixty thousand (60,000) pedestrians were injured in traffic accidents. Most of the injuries sustained were serious and included some fatalities.

Research shows that cars travelling as slowly as 10 mph can severely injure or result in the death of a pedestrian. Thus, it is important for drivers to learn the basic rules of fault and what to do immediately after an accident.

Because hitting a pedestrian is a scary occurrence, most drivers that hit pedestrians are extremely upset right after the accident. Drivers must take note of the following if they are involved in a pedestrian accident:

Safety comes first – experts say that “first, get the injured people to a safe place. Do not attempt to administer medical treatment beyond what is needed in an emergency such as CPR”.
Get medical and legal help – contact the police, medical care providers and auto insurance providers (both for the pedestrian and the driver).
Exchange contact information even if the pedestrian is not incapacitated: exchange your name, phone number and insurance information.

In any accident, especially a pedestrian accident, the question of fault is one of the most fundamental questions that can be asked, that is, whose fault was the accident? The general determination of fault is by the law of negligence. A person who fails to practice the reasonable standards of care under the circumstances may be considered as negligent. Further, it is possible to find both the driver and the pedestrian to have been negligent. In Alaska, if both the driver and the pedestrian are at fault it means that the pedestrian can recover some damages even if he or she is partly at fault for the accident. An injured pedestrian can file a claim against the driver or vehicle owner’s auto liability insurance policy which the driver will be covered with.
