This article will discuss baby head injuries and how to determine who is liable for the related medical malpractice.

Birth injuries are not uncommon; however, while some are minor and can heal on their own, others are more serious and require intensive medical treatment. This article will discuss baby head injuries and determining who is liable for the related medical malpractice.

Baby head injuries can range from minor to severe. Minor head injuries in babies include swelling on the scalp and bruising. In some cases, such minor baby head injuries may heal with little to no medical interventions. More serious baby head injuries include the following:

Cephalohematoma - this is the accumulation of blood under one of the skull bones which usually heals on its own in a few weeks up to a few months.
Skull fractures - this happens when one or more bones of the skull are broken during delivery. While skull fractures normally happen and heal quickly without the need for medical treatment, an indented skull fracture is more serious and takes longer to heal.

Bleeding in the brain - this is also known as intracranial hemorrhage and is a result of the rupture of a blood vessel in the brain. The bleeding in the brain is caused by inadequate blood flow to the brain or a low amount of oxygen in the blood. There are three categories of bleeding in the brain, these are
Subarachnoid hemorrhages - this is the most common type of hemorrhage and happens in full-term births and can result in seizures during the first few days of life.

Subdural hemorrhage - these are more severe and require surgical interventions. They cause pressure on the brain and are normally accompanied by seizures and high bilirubin levels.

Intraventricular and intraparenchymal hemorrhages - intraventricular hemorrhage happens in the ventricles of the brain and intraparenchymal happens in the brain tissue. Both are common in premature babies with underdeveloped brains.

Cerebral palsy - this is one of the most serious baby head injuries, it impairs the brain’s ability to control muscle and motor movements in the body. A diagnosis can be made after birth or after a few years.

Baby injuries often happen due to medical malpractice - an act or failure to act by a medical professional. “One of the hardest things in a birth injury lawsuit is determining exactly what happened during the delivery and who was responsible for what happened”, stated a medical malpractice attorney from Crowson Law Group. “Typically, the physician who delivered the baby, the nurses and the hospital are named as defendants in a birth injury lawsuit”.

The physician may be held responsible for the birth injuries if he or she failed to exercise the same standard of care that another physician in a similar circumstance would have exercised. The physician may also be held responsible for the acts or omissions of the nurses, residents, interns and other physicians under his authority during the delivery. Similarly, nurses have a standard of care, like that held by the physicians, and they may be held liable for failure to act or acting below such a standard. The hospital must exercise the standard of care that other hospitals would under similar circumstances and may be held liable for acting or failing to act in accordance with such standards.
