Did A Defective Product Result In A Wrongful Death?

This article discusses injuries and wrongful death as a result of defective products and the associated claims.

Defective products are common in small numbers but do not always cause widespread damage or lead to severe injury. In fact, in most cases a defective item just does not work but cannot perform as originally intended. That said, there are a number of incidents caused by certain objects purchased from a distributor or retail store that have been shipped from the manufacturer who created or designed the defective product. It is as a result of these events that may be most catastrophic where a purchased object or material causes the death of someone involved.

One article stated the following with regards to injuries through defective products; “It is not expected to purchase a product and become injured through its use. However, some items when used as intended or directed to cause harm to those that buy them. These may be simple appliances such as toasters, blenders, lawn mowers and similar household purchases or these incidents may be caused by large and heavy-duty expenses that include cars, medical gear required for daily living and sporting goods. It is believed that these items would be safe for typical use, and there is no thought about the need for safety when using these objects as originally directed by manufacturer.”

However, when such objects result in injury it may be understandable but if these supposedly safe objects result in the death of an individual while using such products this may result in a wrongful death. There are many situations that involve a wrongful death when using household products or other objects. For example, if an automotive part has been purchased as defective it may include tires that malfunction, brakes that do not work and other pieces of the vehicle that may cause further damage. Electrical purchases that are defective could result in burns, deep gashes and scars from these wounds. Industrial machinery could cause multiple accidents and death very easily when defective materials cause malfunctioning parts.

One attorney stated that, “There are a number of products that may cause injury to the extent of death but often these are in larger purchases of vehicles and industrial equipment. If this does happen it is imperative to contact Anchorage lawyers [https://www.crowsonlaw.com/anchorage-law-firms/] to ensure that everything is filed on time and within the statute of limitations. There are many types of damages that may be recovered when someone’s loved one dies due to defective products. For example, lost income of the deceased and for negligence and the duty of care owed to the person who died compensation is provided to the surviving spouse or children of the deceased. Other monetary compensation may also be provided based on other factors of the claim.”

The attorney further stated that it is important to note that in wrongful death lawsuits it is possible to include multiple parties and more than one entity as being held responsible. Other factors that may be included in the suit is the possibility of dependents of the deceased, statute of limitations, etc. As a result, it is essential to obtain a lawyer in order to ensure that everything is processed correctly with fewer complications.
