Boeing 737 MAX 8 Victims Compensation

According to a CNN report dated March 11, 2019 with the title ‘Ethiopian airlines crash in second disaster involving Boeing 737 MAX 8 in months’, it was recorded that “For the second time in less than 6 months a brand new Boeing aircraft has crashed just minutes into a flight. All 157 people on board the Ethiopian Airlines flight from Addis Ababa that crashed on Sunday morning have died, the airline has confirmed. The tragedy follows the Lion Air flight that went down over the Java Sea in late October killing all 189 people on board.” Because of how common it is for people to travel by air nobody likes to think about being in a plane accident when traveling. However, it does happen and as a result, it is necessary to know what to expect should it happen.

“Firstly, it is important to note that there is important information with regards to what will happen after a plane crash that is printed at the back of a person’s plane ticket. This information is concerning what an airline is required to do by law in the event of an accident.” One article stated that with regard to international flights an international air carrier treaty was put in place in 1999 to address what should happen after an aircraft accident. The treaty was made at a Montreal Convention and was thereafter adopted by the United Nations agency known as the Civil Aviation Organization (CAO). In this treaty, it stipulates that if an airline is found at fault for an accident any affected passenger is to get a minimum value equal to 113,100 special drawing rights. Such plane crash compensation currently values approximately $170,000 per passenger. However, the article notes that there have been limitations placed on victims with regard to what they can recover from an airline under the international treaties and laws. If it can be proven that the airline failed in its duty to its passengers to take all the necessary precautions for a flight, there will be no limit to what in victim can recover.

Generally, every plane crash is heavily investigated. There is quite a bit of data that is collected in order to determine the reason for a plane crash; information such as the cockpit voice recorder and flight data recorder that make up the black box of a plane. And it is from this information that a determination is made as to whether the pilot, airplane or airplane parts manufacturer or others were at fault for the plane crash. In most cases, liability can be assigned on a percentage basis, for example, it is possible for an airline to be 30% at fault for an accident and for the manufacturer to be found 70% at fault, if there were faulty parts that resulted in the plane crash. If this is the case the settlements that plane crash victims will receive is based on the percentage of the determined liability.
