This is about a note on the replacement responsible entity. Although this remains a much explainable as well as a discussable topic, but to minimize the length the main parts has been discussed.

Sydney, Australia------The investment landscape has suddenly experienced a vast modification due to the financial crisis raised financially by either the significant reduction of the value or the performance in terms of investment to the property trusts. The global crisis of finance got raised because the members started either selling since their schemes get liquid or sold off for incurring a substantial loss. Moreover it has made an increment to the likelihood which members will be seeking for the removal of replacement responsible entity and make a replacement with some others.

However, it is a question that how can one go about replacement of their responsibility entities as too many uncertainties are there in terms of the steps that got set by the 'Corporations Act 2001'. In the same way the replacement responsible entity needs to be cautious about thinking over some scheme which they almost don't have any idea and will be undertaking a due attentiveness towards getting some scheme which will include:

Investments
Finance
Contracts of materials
The requirements of Corporations Act for the members to make a replacement of the responsible entity:

During the year 1998, the Corporation Act's Chapter 5C got introduced which deeply regulated the managed schemes of investment which even include the provision of the 'responsible entity' for operating all the schemes along with performing all kinds of functions that got conferred by the Corporation Act and the constitution.
From section 601FM (1) the power of members in order to make a removal of the current responsibility entity as well as choosing the new entity got drawn.

A note about the replacement responsible entity along with the consent:

Section 601NE will be providing a detail about the members who desires to remove the responsibility entity, but would not give any kind of consent to any companies to take the new role of responsibility. Section 601NE will be providing a detail about the members who desires to remove the responsibility entity, but would not give any kind of consent to any companies to take the new role of responsibility.

However, there remain altogether two interpretations within the 610NE (1) (d) and 601FM that is related to the timing as when the consent regarding the replacement responsible entity should be given as well as can be taken.

What is the idea behind the causes of due diligence?

If alteration or modification takes place in any way to the registered scheme of the responsible entity under section 601FS, readily the responsible entity which has been chosen newly would be acquiring all rights along with the liabilities and obligations of the responsible entity who was holding the position formerly and has got a lot of relation with the scheme. Also, there remains a form that is related to the 'statutory Novation' about the contracts of the former responsibility entity that will be holding the trust on the behalf of scheme members.
