The parole lawyer advocates on behalf of prisoners seeking parole or a release from prison before the termination of a sentence. Parole lawyers also work on behalf of parolees when their parole is threatened with revocation. Parole or criminal lawyers may practice on their own. Alternatively, they may practice in a law firm as an associate (a salaried attorney) or as a partner (a part-owner of the firm). After several years of practice with a firm, an associate may become a partner.

A non-violent second strike parole lawyer reviews a process in which the California Department of Corrections and Rehabilitation refers certain determinately-sentenced nonviolent offenders to the Board for review and possible release, once the inmate has served the full term of his or her primary offense. Inmates are reviewed for release based on their criminal history, a review of their institutional records, and after consideration of input received from the inmate, victims, victims’ families, and the district attorney’s office that prosecuted the inmate. A decision is rendered after an administrative review of relevant and reliable documents; no hearing is conducted.

The three strikes parole lawyer sentences the offenders who have committed a number of violent crimes. Concerns about the fairness and proportionality of the law have been raised when an offender is sent to prison for 25 years for shoplifting or some other minor property crime.

Restitution hearing lawyer orders a defendant to compensate the victim for losses suffered as a result of the crime. Restitution is included as part of a sentence in a criminal case when:

• The court considers it necessary for rehabilitation
• It’s needed to make the victim "whole," and
• The victim’s financial losses are directly related to the defendant’s crime.

Restitution is almost always part of the sentence in theft or fraud cases; the court directs the defendant to pay back the amount stolen. In addition, many states require mandatory restitution for certain offenses, such as crimes against the elderly, domestic violence, sexual assault, hate crimes, child abuse, child sexual abuse, drunk driving, and identity fraud.
