If you’ve failed or refused a DOT drug or alcohol test, you cannot legally return to any safety-sensitive duties until you complete the SAP Evaluation Process, as outlined by the Department of Transportation’s regulations under 49 CFR Part 40.

🧾 What is the SAP Evaluation Process?
The Substance Abuse Professional (SAP) Evaluation Process is designed to determine your readiness to return to duty and to ensure public safety. Here's how it works:

1️⃣ Initial SAP Evaluation
You’ll meet (in-person or virtually) with a DOT-qualified SAP who conducts a clinical assessment of your substance use history, employment status, and violation circumstances.

2️⃣ Education or Treatment Program
Based on your evaluation, the SAP will recommend either an education program (for low-risk violations) or a treatment program (such as counseling, rehab, or group sessions).

3️⃣ Compliance Period
You must complete the SAP’s prescribed recommendations before moving forward. Compliance is verified by program completion documents.

4️⃣ Follow-Up SAP Evaluation
Once you finish the program, you’ll undergo a final evaluation with the same SAP to determine if you're eligible for the Return-to-Duty (RTD) test.

5️⃣ Return-to-Duty Test & Monitoring
After SAP approval, you must pass a DOT-observed drug or alcohol test. The SAP will also provide your employer with a Follow-Up Testing Plan, which includes at least 6 unannounced tests over 12 months.
