SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS to help stakeholders understand new legislation on batteries and waste batteries that has been published by the European Union (EU).

Regulation (EU) 2023/1542 was issued on July 28, 2023. This establishes requirements for all batteries in regard to sustainability, safety, labeling and information. It applies to:
• Portable batteries
• Starting, lighting and ignition batteries (SLI batteries)
• Light means of transport batteries (LMT batteries)
• Electric vehicle batteries
• Industrial batteries
• Batteries incorporated into or added to products or that are specifically designed to be incorporated into or added to products

SGS has published SafeGuardS 115.23 to help stakeholders understand the provisions in the new regulation. These include requirements for technical documentation, model structure for the electronic format of the EU declaration of conformity (DoC), compliance with Annex XVII of Regulation (EC) 1907/2006 (REACH), carbon footprint declaration and conformity assessment procedures.

Regulation (EU) 2023/1542 will enter into force on August 17, 2023, with provisions applying from February 18, 2024, unless otherwise specified. Directive 2006/66/EC on batteries and accumulators and waste batteries and accumulators will be repealed from August 18, 2025, with the exception of a few provisions that will continue to apply for a limited time.
