SGS, the world’s leading testing, inspection and certification company, has published a concise summary of recent revisions to the US state of Oregon’s ‘Toxic-Free Kids Act’.

Permanent Administrative Order (PAO) PH 9-2021 for Phase 3 Rulemaking of the ‘Toxic-Free Kids Act’ was approved by the Oregon Health Authority (OHA) in February 2021 and came into effect on March 1, 2021. This contains, inter alia:
• Updated language – including consistent chemical nomenclature for HPCCCH with chemicals of high concern for children (CHCC) under Washington State’s Children’s Safe Products Act (CSPA)
• New provisions for the substitution, removal or waiver of procedures for children’s products that are:
o Cosmetics
o Intended for children under the age of three, or
o ‘Mouthable’ as defined under ORS 431A.253(8)

The ‘Toxic-Free Kids Act’ was signed into law in 2015. It authorized the OHA to establish and maintain a list of High Priority Chemicals of Concern for Children’s Health (HPCCCH) that are used in children’s products and establish rules governing how manufacturers can comply with the law. Implementation was set to take place over three phases. The recent update is for the third phase.

Children’s products are defined in the Act as any of the following products, or their components, that are made for, or marketed for use by children under 12 years of age:
• Product designed or intended to facilitate sucking, teething, sleep, relaxation, feeding or drinking
• Children’s clothing and footwear
• Car seats
• Children’s cosmetics
• Children’s jewelry
• Toys
