Further Restrictions on Toxics in Packaging Under US TPCH Model Legislation

A look at recent changes to the US TPCH’s Model Legislation on packaging, which came into effect on February 16, 2021.

 
The US Toxics in Packaging Clearinghouse (TPCH) has updated its Model Toxics Packaging Legislation (Model Legislation) to include provisions relating to (ortho) phthalates and perfluoroalkyl and polyfluoroalkyl substances (PFAS).

Under the provisions in the update, issued on February 16, 2021, PFAS are now prohibited and phthalates are restricted to no more than 100 parts per million (ppm). It also adds new processes and criteria for identifying and regulating additional chemicals of high concern in packaging and a new definition for ‘post-consumer recycled material’.

Stakeholders should be aware that the requirement for phthalates is the same as those for lead, cadmium, mercury and chromium (VI).

TPCH was originally established in 1992 by the Coalition of Northeastern Governors (CONEG) to promote the Model Legislation, which restricted the four listed heavy metals. The legislation covers packaging and packaging components, and it has been adopted by California, Connecticut, Florida, Georgia, Illinois, Iowa, Maine, Maryland, Minnesota, Missouri, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Vermont, Virginia, Washington and Wisconsin.

The Model Legislation also provides certain derogations to these restrictions and requires manufacturers/suppliers to provide a certificate of compliance (CoC) to packaging purchasers, and upon request, to state agencies and members of the general public.

The revised Model Legislation came into effect on the day it was issued, February 16, 2021.
