There have been 3 or more attempts to repair the same defect in the car. But the issue continues to persist in the vehicle during the warranty period

The car has been out of service due to one of the below reasons:

Due to it being under repair at the workshop
Due to the invalid refusal to repair by the dealer

If the car has been out of service due to these causes for 11 days or more then the car can be classified as a lemon under the Used Car Lemon Law in Massachusetts.

What about parts coming in for the repair work?

The law stipulates that over and above the 11 days in repair, the manufacturer gets 21 additional days to procure the parts needed to fix the car. All these days must occur within the warranty period of the used car. All days post this duration of 21 days will be counted towards the 11 days to the manufacturer to repair the car.

What if the dealer doesn’t repair the car?

As per the law, the dealer is entitled to attempt the repairs to a vehicle within the warranty period. If even after 3 such attempts the remedy is not made, then the car is classified as a lemon. Every single day that the dealer refuses will be counted towards the 11 days needed to classify a car as a lemon.

A dealer can opt for forego repair only under one situation – if he offers to arrange a buy-back. So, both ways the law will stay on the consumer’s side

The buy-back process

The dealer can offer to buy back the vehicle instead of repairing it for the faults. He will have to shell out the full purchase price paid by the consumer. The dealer will have to make the request in writing. The buyer will have to accept the same within 5 days of making the offer. In any scenario, if the dealer withdraws the buy-back offer then this rekindles the warranty repair stipulation that existed before the buy-back offer was made.
