Government Refuses Extension of BIS Toy Certification Order Enforcement

The toy industry of India is facing a challenging situation after the government rejected the additional time demanded by toy manufacturers and importers for extension for enforcement of BIS certification order. The manufacturing and importing of toys has been put under compulsory BIS certification quality control starting September 1, 2020. The certification has been issued under the Toys (Quality Control) Order, 2020 issued by Department for Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce and Industry, Government of India.

With the toys (Quality Control) order being passed from the first day of September, all the toys and raw material which is to be used for toy manufacturing for children below the age of 14 years are now required for BIS Registration. The certificate is mandatory in order to be eligible to operate in the Indian market which is majorly dominated by Chinese products. Moreover, the unavailability of a proper certification from BIS amounts to criminal liability which can result in imprisonment or substantial fines.

In presence of a proper quality control scheme sets up a powerful system to help affirm the quality of toys sold in the Indian market while ensuring self-reliance. This in turn can prove to be a positive situation for both manufacturers as well as the buyers. However, the Industry associations are of the opinion that the process of complying to the order will hamper the toy trade in India to a large extent. It is opinionated, that process change of such magnitude should be given a proper time period as it requires transition.

Although six months of time was given to interested parties, but Covid happened. Eventually, the quality control order was processed in late August and marking fees was informed after a week on 29 August and by 1st of September the process was completed.

So, the deadline given to comply with the order has been quite short and has caused a lot of difficulty as informed by a lobby of All India Toys Federation (AITF).

AITF represents over 59 toy associations across the country which mainly comprises manufacturers of toys, wholesalers as well as importers. The federation is quite worried of the fact that businesses engaged in toy manufacturing are going through a financial crunch, and may find it quite difficult to adhere to the standards right away. The problem aggravates further because having a valid BIS certificate is now mandatory to manufacture as well as import new toys.
