Delhi HC Issues Notice On Abuse Of Animals At Model Delhi Zoo

The petitioner prayed for the probe of C.B.I. for the illegalities held at the ‘Model Zoo’ of the Country.

 
A Petition was filed before the Hon’ble Delhi High Court by an Environmental Activist, named as Ajay Dubey, the founder of the Bhopal-based environment group “Prayatna” to demand the C.B.I. probe into the matter of alleged illegal trafficking of animals and their Parts. In which Delhi High Court has issued a notice to the Centre, the Central Zoo Authority, Central Drugs Standard Control Organisation and the director of the National Zoological Park, Delhi.

The petitioner prayed for the probe of C.B.I. for the illegalities held at the ‘Model Zoo’ of the Country. Petitioner further prays to suspend the current administration of the of the Zoo and to appoint an interim administration during the pendency of the petition.

The counsel of petitioner Pallav Mongia, along with Pankaj Singh and Sabyasachi Bhaduri contented that the medicines, which were given to the animals had reached to its expiry date and further the reports submitted to Central Zoo Authority were false.

Further, the petitioner has stated that some of the anesthetic drugs were missing named ‘Ketamine’ which is also a listed drug under the Schedule X of the Drugs and Cosmetics Rules, 1945 and it can be easily misused and the authorities have not maintained the appropriate records regarding it. Also, another drug named as “Replanta” had expired and in the records, it was shown that the expiry date of that particular drug is not mentioned whereas a box of the drug clearly states that expiry date as 3 years from manufacture.
Petitioner added further, “Even though the medicine expired in September 2010, the Veterinary Officer continued to issue the same to the animals till 2016. On 19.06.2016 when the same was being issued to a Sikka deer, the Zoo Ranger and the Animal Keeper noticed that the medicine was expired and did not give it to the animal but kept it separately and recorded the same in the Beat Register,”.

Petitioner has further alleged that the “authorities of the National Zoological Park (NZP) have tried to dispose of a horn/ivory that was dubiously collected from the Rhinoceros Maheshwari. The concerned authorities have no plausible explanation for the same and the entire episode reeks of a large syndicate of cross-border trafficking in precious animal parts”.

In the petition, the petitioner has also stated that the authorities of National Zoo Park were giving false information to the Central Zoo Authority under the Rule 11 of the Recognition of Zoo Rules, 2009. Further, the petitioner cited the example of the report submitted, that was, “five Common Langurs were acquired and 2 died, whereas in the report submitted to the CZA by the Director of the NZP dated 02.12.2016 the total acquisitions for the same period is reported as 8 and deaths as 4. The Common Langur, is a Schedule II animal, cannot be disposed of without the prior approval of the CZA. However, the CZA has not granted any such approval as reflected in the Inventory Report for the relevant period”.

Similarly, the gender of the deer which died was not mentioned in the report of two National Zoological Park’s Officer.

The petition stated an incident of 2014 in which a stumped-tail macaque was missing for the one day and the zoo authorities did not even raise an alarm, and on the next day when the head keeper searched, then the body of the macaque was found in the enclosure and no post-mortem was conducted as to know his cause of death.

Dubey stated that he has gone through various authorities concerned but no remedy was granted.
