The Iowa Supreme Court passed a judgment ON June 19th at 6-0, 2014, supporting distribution of abortion pills through telemedicine system. Initially in 2013, there was a ban on abortion given the safety concerns.

Initially in 2013, there was a ban on abortion given the safety concerns. Now, the Heartland system of Planned Parenthood enabled video interaction between patients and doctors from Des Moines. The procedure was followed by dispensing of the tablets to women.

The justice held the rule of Iowa Board of Medicine in violating women’s right, opining that the national standard does not make physical examination by doctor as mandatory before they can buy abortion pill. However, the governor, Terry Branstad, was disappointed. According to him, the Supreme Court struck down Iowa Board of Medicine’s efforts in ensuring high quality health service to women.

But, the Supreme Court justice was strong on the judgment as there was no significant evidence in proving that face to face physical examination of patient provided any enhancement in patient’s safety. Suzanna de Baca, President of Planned Parenthood of Heartland celebrated the ruling as she felt it provided women choice over reproductive rights, undoing political motives.

The Medical Board was found adamant in believing that that 2013 ruling allowed patient’s safety which is critical for females, as the medicines can have adverse side effects. The Board had stressed women to undergo few tests and examination, before they could buy abortion pills. But, there ruling was held, when Planned Parenthood appealed a case against them in the Supreme Court that considered arguments in the month of March.

An attorney general office’s lawyer, who was representing the Board in front of Supreme Court, stood his ground by noting that it followed apt process like public hearing and written comments, prior to making any decision. But, critics disagreed, as they observed the Board passed the rule through verbal petition launched by anti-abortionists. The critics sided with the Supreme Court judgment.

The Board had ruled that only licensed physicians could perform physical exams in person for patients, before giving out abortion pills. The fallout was the ban of telemedicine by Planned Parenthood. As the current ruling has opened gateways for Planned Parenthood of Heartland, more than 7,200 Iowa women could consider abortion pills online on her own will, devoid of any imposed restrictions.

Advocators or abortion rights assert that telemedicine healthcare system is a safe means in allocating legalized medical services to urban as well as rural areas. But, contenders of anti-abortion feel that the system exposes women to buy abortion pills, without arranging needed medical backing in emergency

scenarios. Thus, agreeing with Iowa Board of Medicine ruling of 2013, which deemed the system as unsuitable.

The Planned Parenthood pointed out that the former governor and the Medical Board then, has no qualms about telemedicine abortion procedure. The ban only came when the governor, Terry Branstad dissolved the complete Medical Board. He appointed 10 new members, one of them being a previous legislator who has introduced ‘abortion-limiting’ proposal, and the other, a Catholic Priest.

The Iowa Supreme Court, in its judgment evaded the request by Planned Parenthood in declaring the aborting right should come under Iowa Constitution. This decision occurred, as the justice felt that they do not have to answer these questions, on the event of the Board’s rule violating the Constitution of U.S. Justice David Wiggins (a Democrat), wrote the opinion while Justice Bruce Zager (Republican) was not present in the ruling.
