In recent years, divorce rates have been on the rise in most states. In fact, almost 50% of marriages in America will end in divorce. When we look at Florida, we know that 13% percent of the population (ages 15 and older) are divorced, and in Miami-Dade, these numbers are even higher, at a whopping 16% percent!

As with any legal procedure, it is best to be aware of what options are available to you before engaging the service of an attorney. Some of these options include the following:

- Uncontested Divorce: If there is an agreement and both parties want to end the marriage, they can file for a no-fault uncontested divorce.

- Uncontested Divorce With Minor Child(ren): If there are children involved in the family unit, but each parent wants to keep sole custody of their child/children, they can file for a no-fault uncontested divorce.

- Contested Divorce With Minor Child(ren): If there are children involved in the family unit and both parents want to have joint custody of their child/children, they can file for a contested divorce.

However, if you feel that none of these options fit your situation, there are two other options that you can file for:

- Simplified Dissolution of Marriage (Uncontested): This is a type of contract where the divorce is uncontested and both parties agree on all issues. Both spouses must sign this agreement in front of a Notary Public. The most common issue this addresses is property division.

- Dissolution of Marriage (Contested): This is when the spouses cannot reach an agreement on any issue related to their divorce, including child custody and support or property division. The spouses must attend mediation in order to try to reach an agreement before filing for a contested divorce.

According to Fox, there are a handful of legal procedures that must be followed when filing for any of the above types of divorce in the state of Florida. For example, you cannot file for a no-fault divorce until a mandatory six-month waiting period has been observed and you have filed your dissolution of marriage complaint. You cannot file your dissolution of marriage complaint any sooner than the mandatory six-month waiting period has passed, regardless of the reason for the divorce.

Fox recommends that you consult with a divorce CPA in Miami prior to filing your separation to discuss what options are available to you and which ones would be best in your situation. For example, if one or both parties have children, you will have to decide how to handle child custody. You can agree on it or petition the court. These are just some of the many considerations that will vary from case to case, but all involve finding a solution that works best for your lifestyle and finances.
